Jem Design Contest

1: Who Can Enter

The Ibanez JEM Design Contest is open to all individuals who agree to, and abide by, the contest rules below. By entering the contest, you will submit and register your personal information with Hoshino and agree to abide by the following rules.
Those who are under 18 years of age need approval from their guardian to participate, which may be verified if the minor entrant is selected as the winner of the contest. Employees of Hoshino/Ibanez are ineligible to enter the design contest.

2: Submission Deadline

* Submission by email.
All submissions must be received by Sunday, June 6th, 2010 at 6pm PDT (Pacific Daylight Time) – this is dependent upon time zone so be sure to check what time coincides with your area. LATE ENTRIES WILL NOT BE ACCEPTED. Dates may be subject to change, check the website for updates.

* Submission by mail.
Must be received by Monday June 7, 2010 JST (Japan Standard Time).


3: How to Enter

Entrant can submit a maximum of three (3) designs per Entry. If Entrant wants to submit 4 or more designs, please submit additional Entries separately as needed.

3-a: Entering through Website.
Please proceed to Entry page by clicking the ENTRY button below. Fill in entry form, then click the SAVE button. You will receive the entry form as a CSV file. Send your design data with this entry form by email attachment to the address that is shown on the bottom of the entry form.

3-b: Entering by mail.
Please proceed to Entry page. (click ENTRY button.) Fill in entry form, then click PRINT button. Please send your design and this printed entry form by mail to the following address:

4: Technical Requirements/Design details

Entrants can suggest specific materials for their designs if desired, but please keep in mind that traditional guitar building materials will work best. Your entry must include a project description in English.

Entrants cannot modify the "Lions Claw," "Monkey Grip", and "Pickguard" elements which are standard on all JEM models, with the exception of fixed bridge designs, which can eliminate the "Lion's Claw".

Entrants cannot modify Body outline or Headstock outline.

Entrants need to utilize DiMarzio® pickups.

Entrants must include Ibanez logo on Headstock.

For entry by email:
Entrants can download the design template in JPEG file form by clicking the download button. You can use this template for your design entry.
Design data must be formatted as jpeg file only, with a resolution of 72 dpi and a file size no greater than 1MB (uncompressed).
Judges will be reviewing multiple entries so remember to keep your description as concise and readable as possible.

5: Judging

Judging will be done by Steve Vai and Ibanez. All decisions are final.

Notification of Winners

Ibanez will announce the Winner on the Ibanez web site on July, 7th, 2010, at 7:00 am PDT (Pacific Daylight Time). Ibanez will use the winner’s registered nickname and/or handle name for this announcement. Winner will be contacted by email from Ibanez.

6: Prize

The will be only one winner, and Ibanez will create two custom guitars with the selected design at the Ibanez Custom Shop. One guitar will go to the winner, and the other guitar will go to Steve Vai.

The content and ideas submitted must be original.

Your design should not include or make any reference to any particular region, culture, religion, conflict, politics or commercial entity, nor should it pose or connote negative sentiments or imagery.

Each entrant represents and warrants to Ibanez/Hoshino Gakki Co Ltd that:
The entrant has made their own enquiries in connection with the competition;
The entrant does not rely on any representation, arrangement (whether oral or in writing), letter, material or other document or other conduct as adding to or amending these Rules.

In making its Submission, the entrant does not rely on any warranty or representation made by or on behalf of Ibanez/Hoshino Gakki Co Ltd, except those implied by law;
The entrant has relied entirely on its own enquiries and assessment in making its Submission;
The entrant has examined all information relevant to the risks, contingencies and other circumstances affecting its Submission;
The entrant has read these Rules and has satisfied itself about all matters referred to in it;
The entrant owns all rights, title and interest throughout the world in and to any copyright in any material in the Submission; and
Neither the making of a Submission nor the use of any material in a Submission:
infringes, or is alleged to infringe, the intellectual property rights of any third party; or
is, or is alleged to be, in breach of any obligation of confidence owed to any third party.
Each entrant enters the competition at its own risk, cost and expense.

No responsibility is assumed on our part for late entries or corrupted files. Incomplete entries or entries that do not comply with the above format specifications will be automatically disqualified.

Note: Due to the high volume of last-minute entries, and the technical problems can that arise, WE STRONGLY ADVISE YOU to submit your entry well in advance of the submission deadline. It is not possible to respond about the examination passage, the inquiry concerning the result, or the complaint.

Entrant’s designs

May not have been made commercially available, won any other prize/award, or previously submitted to any other contest;
must be the exclusive original work of the entrant and made for the JEM contest;
must be in keeping with Ibanez’ image;
may not be inappropriate, offensive, libelous or defamatory, pornographic, sexually explicit, unlawful or plagiarized, as determined by Hoshino in their sole discretion;
must not be harassing, abusive, threatening, harmful, vulgar, profane, obscene, excessively violent, racially, ethnically or otherwise objectionable or offensive in any way, as determined by Hoshino in their sole discretion;
may not violate or encourage others to violate any applicable law, statute, ordinance or regulation;
may not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or property rights or any other third party rights;
may not contain commercial/corporate advertising, including but not limited to corporate logos, brand names, and slogans, other than those relating to Hoshino/Ibanez or Steve Vai;
All Entries submitted will remain the exclusive property of the entrant, provided that:

entrant will not acquire any ownership or other interest in any and all trademarks, logos and other intellectual property of Hoshino contained in the Work;
except as expressly required in these Official Rules, entrant may not use the Sponsor Marks (Ibanez, JEM, Steve Vai) in any manner whatsoever in connection with the Work or otherwise without the relevant Sponsor's express prior written approval;
By participating in this Contest, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the judges and warrants that s/he is eligible to participate in this Contest. By accepting a prize, winner agrees to release Sponsors, their directors, employees, officers, and agents, including without limitation, their advertising and promotion agencies, from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of the prize or participation in any prize-related activities.

ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

Sponsors and judges are not responsible for late, lost, stolen, damaged, garbled, incomplete, misaddressed, postage due, incorrect or misdirected entries, mail or communications, for errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise.

Sponsors and judges are not responsible for electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's e-mail account to receive e-mail messages.

Sponsors disclaim any liability for damage to any computer system resulting from participation in, or accessing, posting, uploading or downloading information in connection with, this Contest, and reserve the right, in their sole discretion, to modify, cancel, terminate or suspend this Contest should any virus, bug, technical failures, unauthorized human intervention or other causes beyond Sponsors' reasonable control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In the event of any such cancellation, termination or suspension, a notice will be posted on the Contest Site and the winners will be selected from among all eligible entries received prior to such time. Sponsors reserve the right, in their sole discretion, to disqualify any entrant from this Contest or any other promotion conducted now or in the future by Sponsors or any of their affiliates if the entrant's fraud or misconduct adversely affects the integrity of the Contest.

Please make any copies of original artwork prior to submission as none of the entries will be returned to the entrants.

The JEM Design contest prize will ship from Los Angeles, CA, USA. Ibanez/Hoshino Gakki Co Ltd will pay for the shipping cost, however, all taxes and duties owed will be paid by the winner based on the laws of the territory in which the winner resides.

Check your entry carefully prior to submitting as there is no way to retrieve your entry once it has been sent.

Contest dates may be subject to change. Any change of date will be posted to the website News section and to the specific Contest web page.

7: Official Privacy Policy of the JEM design Contest.

Your privacy is critically important to us. We have a few fundamental principles:

We don't ask you for personal information unless we truly need it.
We don't share your personal information with anyone except to comply with the law, develop our products, or protect our rights.
We don't store personal information on our servers unless required for the on-going operation of one of our services.
